MyComplaintSA – Privacy notice for attorneys and firms we contactThis notice explains how MyComplaintSA (Pty) Ltd uses information about attorneys and firms of attorneys that it contacts about listing on the MyComplaintSA platform. It is given under section 18 of the Protection of Personal Information Act 4 of 2013 (POPIA).1. Who we areMyComplaintSA (Pty) Ltd (registration number 2021/849413/07), 18 Stellenberg Road, Somerset West. Our Information Officer is Prof Theo Broodryk: [email protected], +27 (0)21 569 4811.2. What we hold and where it came fromWe hold the following information, taken from your firm's own website or from a public legal directory:your firm's name;
the town or towns where it practises;
its website address;
the practice areas it publishes;
the names and business email addresses of the attorneys it names.We also keep a record of our contact with you. This record includes the dates, your reply and the practice areas you chose. It also includes our note of which of our practice areas your published profile appears to fit.3. Why we use itTo ask you once, by email, whether you would like our founding-listing offer. POPIA permits this single request (section 69(2)).
If you say yes, to send you the offer for the practice areas you name and to deal with any reservation you make. If your firm takes a place, the listing terms govern our use of its information from then on.
If you say no, or do not reply, to keep a short record so that we never contact you again.We rely on our legitimate interest in offering listings to suitable firms (section 11(1)(f)). We use information that your firm has made public (section 12(2)(a)). Once you say yes, we also rely on your consent (section 69(1)(a)).4. Your choiceReplying is voluntary. If you do not reply, nothing follows. The only consequence is that you do not receive the offer.5. Who sees itOnly MyComplaintSA's founder and Managing Director, and the service providers that host our email and records. Those providers process the information for us under written terms (sections 20 and 21). We do not sell your information. We do not share it with anyone for their own marketing.Our email is provided by GoDaddy, a United States company, which stores and processes it outside South Africa. GoDaddy's data-processing terms require it to:process the information only on our instructions;
keep it secure and confidential;
notify us of any breach;
use sub-processors only after checking that they can comply with those terms.We rely on those terms for the transfer (section 72(1)(a)).6. How long we keep itIf your firm does not take a place, we delete its details by 31 January 2027, three months after the founding offer closes. We keep one do-not-contact entry: firm name, email address, date and outcome. We keep it for as long as we market listings to attorneys, because it is how we make sure that we never contact you again.7. Your rightsYou may:ask what information we hold about you (section 23);
ask us to correct or delete it (section 24);
object to our use of it (section 11(3));
withdraw your consent at any time.Reply to our email or write to the Information Officer.
